California points to reflect in your templates

General pointers only. Rules change, so confirm the current requirements with your board, agency or counsel.

  • Two licensing boards. Psychologists are licensed by the California Board of Psychology; LMFTs, LCSWs and LPCCs by the Board of Behavioral Sciences. Both expect records that document assessment, treatment and progress, and both set rules on retention, with special provisions for minors.
  • State medical privacy law. California's Confidentiality of Medical Information Act applies in addition to HIPAA and is stricter in some areas, including disclosures. Mental health records have further protections under state law.
  • County and Medi-Cal work. Agencies providing specialty mental health services through the county follow state and county documentation standards, which have been revised in recent years. Use the current forms your agency gives you and mirror them in your templates.
  • Telehealth. When you see clients by video, document the modality and the client's location as your payers require, and make sure you are licensed in the state where the client is during the session.

Does it follow California privacy law automatically?

No tool can make a practice compliant on its own. My Clinical Writer protects data as described on our security page; you remain responsible for how records are kept, shared and released under HIPAA and California law.

Can I document sessions held in Spanish or another language?

Yes. Provide the session material in the language it happened in and ask for the note in English. Check translated content carefully and record interpreter use where required.
