1. Acceptance of Terms
By accessing or using My Clinical Writer ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, then you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Service Description
My Clinical Writer is an AI-powered documentation software designed to assist healthcare professionals in creating clinical documentation. The Service includes:
- Audio transcription capabilities
- Report generation tools
- Template-based documentation
- Multi-language support
- Cloud storage for documents
The Service is provided as a tool to assist in documentation and does not replace professional medical judgment or clinical decision-making.
3. User Accounts
3.1 Registration
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

You may not use another person's account without permission. You may not create multiple accounts for the same individual or entity unless expressly permitted.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are owned by My Clinical Writer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 User Content
You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service to you.

- All clinical decisions remain the sole responsibility of the healthcare provider
- All generated documentation must be reviewed and verified by the user before use
- The Service does not replace professional medical judgment
- Users are solely responsible for ensuring their documentation meets all applicable regulatory, legal, and insurance requirements
- We make no warranties about the accuracy, completeness, or suitability of generated content
- Users must provide their own licensed diagnostic resources and references
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE SPECIFICALLY DISCLAIM ANY LIABILITY FOR ERRORS OR OMISSIONS IN ANY CONTENT GENERATED BY THE SERVICE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MY CLINICAL WRITER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless My Clinical Writer, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.
11. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us at support@myclinicalwriter.com.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Houston, Texas.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
