New York's documentation load

New York has one of the densest mental health workforces in the country, and one of the most varied. A psychologist might see private-pay clients in a Manhattan office, work a few days in an outpatient clinic in the Bronx or Brooklyn, and write evaluations for court or schools on the side. New York rules to build into your templates

These are general pointers, not legal advice. Check the current text with your licensing office, program or compliance team.

  • Professional licensing. Psychologists, LCSWs, LMSWs, LMHCs and LMFTs are licensed through the New York State Education Department's Office of the Professions. Its rules on professional conduct include keeping records that accurately reflect the evaluation and treatment of each client, and retaining them for a minimum period, with longer periods for minors.
  • Licensed clinic programs. Outpatient clinics licensed by the Office of Mental Health follow program regulations, commonly referred to as Part 599, along with agency policy, for what assessments, treatment plans, plan reviews and progress notes must contain and when they are due. If you work in such a clinic, set up a template for each required document so every draft has the expected sections.
  • Confidentiality. New York's mental hygiene law adds confidentiality rules for clinical records in addition to HIPAA. Your program's privacy officer is the right person to ask about disclosures.

Does it handle sessions in languages other than English?
